Skillsprouts Academy – Liability Waiver & Disclaimer

IMPORTANT NOTICE – PLEASE READ CAREFULLY
By enrolling in or accessing any physical activity program, lesson, or video provided by Skillsprouts Academy (“we,” “us,” or “our”), you (the “Participant” and/or the “Parent or Legal Guardian”) agree to the following legally binding terms.
1. Assumption of Risk
I understand that physical activities offered by Skillsprouts Academy may include, but are not limited to, running, jumping, rolling, balancing, and other movements that involve physical exertion and coordination. I acknowledge that participation in such activities involves inherent risks, including but not limited to falls, sprains, strains, broken bones, head injuries, or even death.
I freely and voluntarily choose to participate (or allow my child to participate) in these activities. I hereby accept and assume full responsibility for all known and unknown risks, including any resulting injury, illness, or damage.
2. Parental Responsibility and Supervision
If I am a parent or legal guardian, I acknowledge that I am fully responsible for supervising my child during all activities. Skillsprouts Academy does not offer live instruction or oversight and cannot assess the suitability of any activity for my child’s individual condition.

3. Waiver, Release, and Hold Harmless
To the fullest extent permitted by law, I hereby waive, release, discharge, and hold harmless Skillsprouts Academy, its owners, instructors, affiliates, partners, contractors, and representatives from any and all claims, demands, liabilities, damages, losses, or causes of action related to participation in its programs — including those caused by ordinary negligence.
This waiver does not apply to gross negligence or intentional misconduct.
4. No Medical Advice
I understand that Skillsprouts Academy is not a medical provider and does not offer medical, diagnostic, or therapeutic advice. The content is intended for educational and recreational use only. I agree to consult a physician before beginning any new physical activity for myself or my child.
5. No Guarantees or Promises
I understand that no specific results are promised or guaranteed. The effectiveness of the program may vary depending on the participant’s age, condition, environment, and other factors outside of Skillsprouts Academy’s control.
6. Legal Authority to Waive on Behalf of a Minor
If I am signing on behalf of a minor participant, I certify that I am the child’s parent or legal guardian and have full legal authority to agree to this waiver on their behalf. I agree to indemnify and hold harmless Skillsprouts Academy from any claims brought by or on behalf of the minor — including claims initiated after the minor reaches the age of majority.
7. Governing Law and Jurisdiction
This agreement shall be governed by and construed in accordance with the laws of the Netherlands. Any legal dispute shall be exclusively resolved in the courts of the Netherlands, unless otherwise required by applicable law.
8. Arbitration and Class Action Waiver
In the event of a dispute, both parties agree to resolve the matter through binding arbitration in the Netherlands, rather than in court. Each party waives the right to participate in any class action or class-wide arbitration related to this agreement.
9. Severability
If any provision of this waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10. Electronic Agreement
By clicking “I Agree” or accessing Skillsprouts Academy’s content, I confirm that I have read, understood, and voluntarily agree to this waiver and release of liability. This electronic acknowledgment is legally binding and serves as a digital signature under applicable law.
